Welcome to Hercules Containers. By accessing or using our website at https://herculescontainers.com or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our website or services.

1. Services Description

Hercules Containers provides storage container rental, sales, and modification services in the Durango, Colorado area. Our services include but are not limited to:

  • Storage container rentals (10ft, 20ft, 40ft, and specialty sizes)
  • Container sales (new and used)
  • Rent-to-own programs
  • Custom container modifications (shelving, roll-up doors, ventilation, electrical)
  • Container delivery and pickup
  • Generator housing and specialty builds

2. Rental Terms

Container rentals are subject to the following general terms:

  • Rental periods are billed in 4-week increments
  • Minimum rental period is 8 weeks unless otherwise agreed in writing
  • Rental rates are as quoted at the time of agreement and may be subject to change upon renewal
  • Containers remain the property of Hercules Containers throughout the rental period
  • Renters are responsible for maintaining the container in reasonable condition during the rental period

Specific rental terms, including pricing, duration, and conditions, are detailed in individual rental agreements signed at the time of service.

3. Rent-to-Own Terms

Rent-to-own programs allow customers to apply a portion of monthly rental payments toward the purchase price of a container. Specific terms, including purchase price, monthly payment amounts, and the percentage applied to ownership, are outlined in the individual rent-to-own agreement. Early buyout options may be available.

4. Payment Terms

  • Payment is due upon delivery for purchases and at the start of each billing period for rentals
  • We accept major credit cards, checks, and cash
  • Late payments may incur additional fees as specified in your service agreement
  • A deposit may be required for rentals and custom modifications

5. Delivery and Pickup

Delivery and pickup services are available within our service area. Delivery fees are based on distance and site conditions. The customer is responsible for ensuring adequate access and a suitable, level surface for container placement. Hercules Containers is not responsible for damage to driveways, landscaping, or underground utilities unless caused by our negligence.

Customers must provide at least 48 hours' notice for delivery or pickup scheduling. Cancellations with less than 24 hours' notice may incur a fee.

6. Container Condition

All containers are delivered in wind- and water-tight condition unless otherwise noted. Used containers may show cosmetic wear including surface rust, dents, or paint variations, which do not affect structural integrity or weather-tightness. New ("one-trip") containers are in near-new condition.

Customers should inspect the container upon delivery and report any concerns within 48 hours. At the end of a rental period, containers must be returned in substantially the same condition as delivered, normal wear and tear excepted.

7. Modifications

Custom modifications are performed according to agreed specifications and timelines. Modification timelines are estimates and may vary depending on complexity and material availability. Renters may not make unauthorized modifications to rental containers without prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, Hercules Containers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

Hercules Containers is not responsible for the contents stored within rented or purchased containers. Customers are encouraged to obtain appropriate insurance coverage for stored items.

9. Indemnification

You agree to indemnify and hold harmless Hercules Containers, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

10. Website Use

The content on our website is provided for general informational purposes only. While we strive to keep information accurate and current, we make no warranties about the completeness, reliability, or accuracy of the information. Container availability, pricing, and specifications are subject to change without notice.

11. Intellectual Property

All content on this website, including text, images, logos, and design elements, is the property of Hercules Containers or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising under these terms shall be resolved in the courts of La Plata County, Colorado.

13. Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue legal remedies in accordance with Section 12.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
